These Terms of Use ("Terms") govern your access to and use of the PhotoPal AI mobile application ("PhotoPal AI," "we," "our," "us," or the "App").
By accessing or using PhotoPal AI, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.
PhotoPal AI is an AI-powered image editing application that allows users to create and modify images using artificial intelligence.

PhotoPal AI is intended for creative, informational, and entertainment purposes.
You may upload images to PhotoPal AI for the purpose of editing or generating new images.
You retain ownership of the images you upload.
By submitting an image to PhotoPal AI, you grant us a limited, non-exclusive right to process the image solely as necessary to provide the App's features and services.
This may include transmitting the image to third-party AI processing providers used by the App.
You are responsible for ensuring that you have all necessary rights, licenses, permissions, and consents required to upload and process any image you submit.
PhotoPal AI may allow you to upload a second image as a reference image.
You are responsible for ensuring that you have permission to use any reference image you upload and that your use of the image does not violate copyright, privacy, publicity, trademark, or other rights of another person or entity.
You may provide written instructions describing the changes you want made to an image.
You are responsible for the content of your instructions and agree not to use the App to request or create content that violates these Terms or applicable law.
PhotoPal AI may generate modified images based on your uploaded images, reference images, and instructions.
To the extent permitted by applicable law, you are responsible for determining whether you have the necessary rights to use, publish, distribute, or commercially use generated images.
Because AI-generated content may incorporate or resemble elements from source material or other content, you are responsible for ensuring that your intended use does not violate the rights of others.
PhotoPal AI uses artificial intelligence to process images and generate requested edits.

You understand that AI image generation is probabilistic and that results are not guaranteed to be accurate, complete, or suitable for your intended purpose.
You agree to review generated images before using, publishing, sharing, or relying on them.
PhotoPal AI may use third-party AI and technology providers to process images and generate results.
The App may use OpenRouter to access AI models, including Google Gemini 2.5 Flash and/or other AI models supported through OpenRouter.
When you submit images or instructions for AI processing, the applicable information may be transmitted to these third-party services in order to provide the requested functionality.
Third-party services are subject to their own terms, policies, and availability. We are not responsible for the independent practices, availability, accuracy, or performance of third-party services.
PhotoPal AI may provide an image history feature that allows you to access previously generated images.
Generated images and related information may be stored as part of your history so that you can conveniently access your previous work.
You are responsible for reviewing and deleting content from your history when you no longer want it retained.

The PhotoPal AI application, including its software, interface, branding, logos, graphics, design, text, and other original materials, is owned by or licensed to us and is protected by applicable intellectual property laws.
Except as expressly permitted by these Terms, you may not:

You retain your rights to content you submit to PhotoPal AI, subject to the limited license necessary for us and our service providers to operate the App.
PhotoPal AI does not claim ownership of your original uploaded images.
AI-generated content may be subject to legal limitations regarding copyright or other intellectual property rights. The availability of an AI-generated image does not guarantee that the image is copyrightable, free from third-party rights, or suitable for commercial use.
You are responsible for determining whether and how you can legally use a generated image.
Your use of PhotoPal AI is also subject to our Privacy Policy, which explains how we collect, use, process, and protect information submitted through the App.
By using PhotoPal AI, you acknowledge that images, reference images, text instructions, and other information may be processed by third-party service providers as described in our Privacy Policy.
The App may depend on third-party services, including AI processing providers, hosting providers, analytics providers, infrastructure providers, and other technology services. Examples may include OpenRouter, Supabase, etc.
We do not control these third-party services and cannot guarantee that they will always be available, accurate, secure, or error-free.
Third-party services may have their own terms and privacy policies, and your use of those services may be subject to those terms.
PhotoPal AI is provided on an "as is" and "as available" basis to the maximum extent permitted by applicable law.

You use AI-generated results at your own discretion and risk.
To the maximum extent permitted by applicable law, PhotoPal AI and its owners, operators, affiliates, employees, contractors, and service providers will not be liable for damages arising from or related to your use of the App or AI-generated content.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
We may modify, suspend, discontinue, or restrict any part of PhotoPal AI at any time, with or without notice.
Features may change over time, including available AI models, image-generation capabilities, processing limits, storage functionality, and supported file formats.
We are not responsible for losses resulting from the unavailability or modification of a feature, except where prohibited by applicable law. Your use of the App is at your own risk.
If the App requires an account, you are responsible for maintaining the security of your account credentials and for activity occurring through your account.
You agree to notify us if you believe your account has been accessed without authorization.
We may suspend or terminate access to the App if we reasonably believe that you have violated these Terms, abused the service, engaged in unlawful activity, or created a security or operational risk.
You may stop using PhotoPal AI at any time.
We may suspend or terminate your access to the App if you violate these Terms or if we reasonably determine that your use of the App presents a legal, security, technical, or operational risk.
Upon termination, provisions that by their nature should survive termination will continue to apply, including provisions concerning intellectual property, disclaimers, limitations of liability, and user responsibilities.
We may update these Terms from time to time.
When we make changes, we may update the Effective Date shown at the beginning of these Terms.
Your continued use of PhotoPal AI after updated Terms become effective constitutes your acceptance of the revised Terms, to the extent permitted by applicable law.
